https://consiguetufactura.com/ is an internet domain owned by APOLLO SOLUTIONS S.L. (hereinafter "APOLLO" or "ConsigueTuFactura"), with registered office at C/ Diego de LeĂłn 47, 28006 Madrid, Spain, holding NIF (Spanish tax ID) B13843859 and registered with the Registro Mercantil de Madrid (Madrid Commercial Registry), Volume 45238, Sheet 61, Entry 1, Page M-795978.

These General Terms and Conditions of Use (hereinafter "GTC") are valid as of their publication and refer to the services purchased at the time these Terms were made available, remaining in force until notice of their amendment or update is given.

These GTC refer to the following service: requesting an invoice on behalf of the user for purchases or transactions made with third-party companies.

Users purchasing our services must be of legal age (at least 18 years old) and have the legal capacity to enter into contracts, confirming that they understand and accept the GTC in full.

In accordance with applicable regulations: documentation relating to contracts will be kept on file for the legal period applicable in each country from the time the contract is concluded. Users may access the documents in which they appear as a party by requesting them from soporte@consiguetufactura.com.

ConsigueTuFactura reserves the right to make, without prior notice, any changes it deems appropriate to the platform and to these GTC. Changes affecting essential elements will not apply to contracts already concluded unless expressly accepted by the User.

Definitions

  • ConsigueTuFactura: Web Platform through which the service of requesting invoices from third-party companies on behalf of the user is offered.
  • User: Person with legal capacity to enter into contracts through the Web Platform.
  • GTC: General Terms and Conditions of Use applicable to all services offered by ConsigueTuFactura.
  • Service: Set of paid services available to Users of the Web Platform.
  • Web Platform: Web-based application accessible at https://consiguetufactura.com/
  • Party/Parties: ConsigueTuFactura and the User.

First: Placing the order and formation of the contract

The User may request the services through the Website by completing a form with their personal details at www.consiguetufactura.com. When requesting an invoice in the name of a legal entity, the User must provide the details of the corresponding company. Billing details will subsequently be requested through the Stripe payment gateway. Upon completing the purchase, the User must expressly accept these GTC and the privacy policy.

Once the user has access to their personal area, they will be able to manage invoice requests for a wide list of companies. In order for ConsigueTuFactura to carry out the process, the user must provide the data and information essential to deliver the service.

ConsigueTuFactura acts as an intermediary between the User and the third-party company to request the invoice corresponding to the purchases or transactions made by the user. From the personal area, the user may review all their requests, the companies notified, the date of notification, and manage their subscription securely.

The user undertakes that the data provided is true, accurate and complete, and in particular that any credit or debit cards used are their own and have sufficient funds. ConsigueTuFactura has no means of verifying with 100% certainty the identity of Users and accepts no liability for the accuracy or inaccuracy of such information.

In the event of doubts as to the accuracy of the information supplied or indications of identity theft, ConsigueTuFactura may suspend access to the service and/or request additional information. If identity theft or false information is established, the contract may be terminated as of right.

ConsigueTuFactura reserves the right to cancel the user's service in the event of a chargeback or of false or unverifiable data.

Mandatory form fields:

  • Full name or company name
  • Type and number of identity document or tax identification (RFC, NIT, RUC or cĂ©dula, depending on the country)
  • Email

The User may correct their data at any time before submitting the request. Any error in the data entered is the sole responsibility of the User.

Second: Conditions of use and liability

ConsigueTuFactura is an independent intermediary between the User and the third-party company. ConsigueTuFactura accepts no liability in the event of a dispute arising between the User and the Company as a result of the notification of the invoice request.

ConsigueTuFactura ensures that the invoice request is sent to the third-party company, but does not guarantee that such request will be processed by the company or that the company will provide the user with its invoice, as this process rests entirely with the third-party company.

ConsigueTuFactura will process accepted requests within approximately 24 business hours. However, due to unforeseen circumstances beyond its control, these timeframes may vary. The user may check the status of their notification from their personal area at any time.

Under no circumstances shall ConsigueTuFactura be liable for delays caused by failures in the IT systems of the companies from which the invoice is requested or of third parties.

The User must follow up on the process and respond to any additional requests that the companies may make during the process (submission of additional data, signing of documents, etc.). Failure to respond is the sole responsibility of the User.

ConsigueTuFactura notifies the invoice request to the third-party company, but confirmation of the sending of the invoice must be provided directly by the company to the User. ConsigueTuFactura does not guarantee that it will take effect.

Quantitative limitation of liability: in any event, and regardless of the nature or cause of any claim, the maximum and total liability of ConsigueTuFactura towards the User shall be limited to the amount actually paid by the User to ConsigueTuFactura during the three (3) months prior to the event giving rise to the claim. This limitation applies to the maximum extent permitted by applicable law and shall not affect the non-waivable consumer rights recognised by consumer protection regulations.

Third: Price and payment terms

ConsigueTuFactura is an intermediary between the User and the Company that must issue the invoice, with no commercial relationship with these companies. Its service consists of sending the invoice request letter/notification to the company whose details the user provides.

The first request is completely free, with no credit card required. For additional requests, the User may purchase one of the following plans (prices in the local currency of each country):

The Monthly and Annual plans renew automatically at the end of each period unless previously cancelled by the User from their control panel. Cancellation takes effect at the end of the current period, at no additional cost. The Basic plan is not a recurring subscription; unused requests do not expire.

Payment is made by bank card through the secure payment gateway Stripe. All operations involving the transmission of personal or banking data are carried out in an encrypted environment using SSL (Secure Socket Layer) technology.

ConsigueTuFactura reserves the right to change the service rates at any time. Changes to such rates will not affect services purchased prior to the date of the change.

Fourth: Right of withdrawal or revocation

If the invoice request has already been sent to the third-party company and the User has the confirmation of sending available in their personal area, the User may not cancel the Service, as it has been performed in full, without prejudice to the non-waivable rights granted to consumers under the consumer protection legislation applicable in their country.

If the User wishes to exercise their right of withdrawal or revocation before the request is sent, they must send an email to soporte@consiguetufactura.com stating that they wish to cancel, provided they have not received the sending notification from ConsigueTuFactura.

ConsigueTuFactura will refund the payment made as soon as the User notifies their intention to withdraw, using the same means of payment used for the purchase. The refund will be free of charge for the User.

The period and conditions of the right of withdrawal or revocation shall be governed by the consumer protection legislation applicable in the User's country of residence (in Mexico, the Ley Federal de Protección al Consumidor (Federal Consumer Protection Law); in Colombia, the Estatuto del Consumidor —Ley 1480 de 2011— (Consumer Statute); in Ecuador, the Ley Orgánica de Defensa del Consumidor (Organic Law on Consumer Protection)).

Fifth: Proof of orders / Records

Except in the case of manifest error, the burden of proof of which lies with the User, the data stored in ConsigueTuFactura's databases shall have evidentiary value with respect to the orders placed.

Data regularly stored on computer or electronic media constitute admissible and enforceable evidence on the same terms and with the same probative force as any document received and kept in writing.

ConsigueTuFactura will deliver the proof of purchase of the service to the email address provided at the start of the request.

Sixth: Customer service

Any request for information, in particular regarding purchases, refunds, changes or the operation of the services, must be addressed to ConsigueTuFactura by email at soporte@consiguetufactura.com or through the Contact section of the platform. You will receive a reply within approximately 48 hours.

Seventh: Satisfaction guarantee

ConsigueTuFactura offers the user a satisfaction guarantee with a 100% refund of payments made within 30 days of the date of the last purchase. If for any reason the user is not satisfied with the Services, they may request a full refund with no justification required. ConsigueTuFactura does not offer refunds for transactions older than 30 days or for accounts that have breached these Terms.

Eighth: Validity of the contract

Should one or more of these provisions be declared null and void or deemed non-binding, the validity of the remaining provisions of the GTC shall not be affected.

Ninth: Obligations and responsibilities of Users

By signing up for the Services, Users undertake to:

  • Make truthful statements consistent with the facts.
  • Comply with the regulations in force and not breach public order.
  • Respect intellectual and industrial property rights.
  • Not commit acts of defamation, insult, discrimination or glorification of crimes.
  • Act in accordance with morality and good practice.
  • Not disclose passwords and confidential access codes to third parties.
  • Not use programs or applications that interfere with the operation of the platform.
  • Not harm the Services or the Web Platform.

Users are solely responsible for the use of the data they view, request or communicate on the Web Platform and undertake to hold ConsigueTuFactura harmless from any claim arising from the breach of their legal and/or contractual obligations.

The user is solely responsible for the inaccuracy or falsity of the data provided and for any damage this may cause to user companies or third parties.

Tenth: Obligations and responsibilities of ConsigueTuFactura

ConsigueTuFactura undertakes to offer Users an online service that complies with the law and to perform the intermediation services with the utmost professionalism and diligence.

ConsigueTuFactura is not liable for cases of fraud, identity theft or other criminal offences committed by Users through the Platform, nor for the truthfulness, authenticity or accuracy of the information provided by Users.

ConsigueTuFactura does not guarantee that the Services will function in the event of an interruption of the User's Internet access or due to force majeure not attributable to ConsigueTuFactura.

Eleventh: Intellectual property

The logos, graphics, photographs, animations, videos and texts appearing on the Web Platform, as well as all elements necessary for its operation, may not be reproduced, used or displayed by any means without the express authorisation of ConsigueTuFactura.

The rights of use granted by ConsigueTuFactura to Users are strictly limited to their private and personal use within the framework of the contract entered into. It is strictly forbidden to modify, copy, reproduce, download, disseminate, transmit, commercially exploit or distribute in any way the Services or the elements comprising them.

The logos and trademarks of third-party companies appearing on the Platform are reproduced in accordance with applicable law, for purely descriptive purposes, without implying any relationship between ConsigueTuFactura and the holder of such rights.

Twelfth: Data protection

ConsigueTuFactura takes the protection of all Users' personal data very seriously and guarantees that it is processed in accordance with the data protection legislation applicable in each country (in Mexico, the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (Federal Law on the Protection of Personal Data Held by Private Parties); in Colombia, Ley 1581 de 2012; in Ecuador, the Ley Orgánica de Protección de Datos Personales (Organic Law on Personal Data Protection)). Thirteenth: Communications and notifications

By accepting these GTC, the User expressly consents to ConsigueTuFactura sending them communications regarding the status of their requests and, where they have expressly agreed to receive commercial communications, information on ConsigueTuFactura's activities, services, promotions and news. The User may revoke this consent at any time.

Fourteenth: Penalties and termination of the contract

ConsigueTuFactura may terminate the contract as of right in the event of a breach of the GTC by the User. In the event of a serious breach, termination may take place without any prior notice.

In the event of termination attributable to the User, the User may not claim any compensation or refund, without prejudice to any damages that ConsigueTuFactura may claim from them.

The User may cancel the Service provided they have not received the notification that the request has been sent to the Company. If ConsigueTuFactura cancels the contract for reasons not attributable to the User, it will refund the full payment made.

Fifteenth: Applicable law and jurisdiction

The service is provided by APOLLO SOLUTIONS S.L. (Spain). However, in relationships with consumers, these GTC and the contract shall be governed by the consumer protection legislation of the User's country of residence (Mexico, Colombia or Ecuador), and the User may bring any dispute before the competent courts or consumer authorities of their place of residence (in Mexico, Profeco; in Colombia, the Superintendencia de Industria y Comercio; in Ecuador, the DefensorĂ­a del Pueblo and the consumer authorities).

In matters not governed by such mandatory consumer regulations, the parties shall submit to the legislation and the competent courts of the User's place of domicile.

Sixteenth: Form for exercising the right of withdrawal or revocation

In accordance with the consumer protection legislation applicable in their country, consumers may exercise their right of withdrawal or revocation before ConsigueTuFactura has begun to provide the services, by sending a communication to soporte@consiguetufactura.com with the following information: full name, date of purchase, service purchased and an express statement of their wish to withdraw.
